Buyer Beware Now I Know What it Means
I saw a clients son who told me an interesting story . Oh am I sorry I didn't call you he said . He saw an old friend and in the conversation it became known that these two friends that we will call Mr buyer and Ms seller could be interested in a sale to purchase a house . Mr buyer had been looking in Ms sellers community for quite a long time .
Ms seller said come look at my house if you like it we do not need a Realtor I have sold many houses she said I know what papers we need to sign and I will save you money . When Mr buyer saw the house it was perfect .It was just what he was looking for . The seller was moving to her vacation house permanently She said she would leave pots and pans ,dishes and whatever he wanted.
This sounded very attractive to Mr buyer and he was so excited as it was his first home The seller was leaving him furniture and an equipped kitchen this was too good to be true To good to be true how many times have we heard this . The seller did have knowledge on paperwork and an agreement was struck . Mr buyer was given a home warranty and saw everything in the house was well taken care of . The windows were new E windows .The A/C was just replaced and the heater was two years old Everything was updated in the house and the price was right .
The buyer came over the day before closing to do a walk through . MS seller only had the furniture out of the house . The house was full of everything else. All of her clothes were in the closets in fact all the closets were full of everything .The furniture was gone except for what was agreed on . Mr buyer was in panic. He asked Ms seller when she would be out. He had his possessions coming plus he had taken the rest of the week off to get settled in . Ms seller said not to worry every thing would be out by the evening . The seller called morning of settlement and said everything was out .She was cleaning so it looked nice . She wanted to store some of her things in the storage shed until the weekend
Settlement took place and Ms seller handed over the keys but said she still had one set . She still had a few things in the house . When Mr buyer went to the house it looked the same as it had the previous night . He was lucky he still was living at his parents The movers and new furniture were not coming for two more days . This went on for two more days . Mr buyer started helping her pack the stuff and carrying it outside with her friends and loading it up into the storage shed and trucks . Finally as his furniture was being delivered she was waving goodbye
Mr Buyer told me he knew it was a mistake as he was signing the papers not to have me looking out for him. Twenty five bags of trash were thrown out. This trash was Ms sellers wonderful things she was leaving Mr buyer and he is not done yet . Ms Seller stayed in the house three days after settlement . She did this for free using all utilities that were in Mr buyers name . He took time off of work to move in and could not . The kitchen was a mess and the refrigerator was full of food .The place was a mess nothing had been cleaned or vacuumed .
There were many nice things that Ms seller did Mr buyer said but now I need to take extra days off from work .
What happened to time is of the essence or broom clean and free of debris
Mr Buyer told me I will never buy or sell a house without using you .I learned I will never buy without representation .You always did a great job for our family . I have learned my lesson the hard way .
