Restricted Videos: The Sequel to Busted By A Mall Cop
After being Busted By A Mall Cop and prevented from taking photos and videos at a local Mall, in Orange County, California, I took time to reflect upon the details that led to my altercation.

It's true that I was wearing a black trench coat which could have aroused a bit of suspicion.
Walking with my hands inside my coat pockets may have warranted a second glance.
Lingering in front of stores with my video camera might have been noticed and reported.
Taking prolonged candid videos of Santa while I was backed into a recessed doorway was definitely observed.
Standing only 50 feet away from a Mall Cop while doing the above was probably too much to ignore.
Do I look Suspicious to YOU?
I agree! But looking suspicious is not the point. It's whether or not WE have the right to take photos or videos at a mall. The answer will almost always be NO, unless you have Mall Management approval.
For your information, after speaking with Mall Management, I was denied permission to video Inside and Outside on mall property. They may grant approval for news organizations or others, but I was denied as a Realtor for the purpose of adding the video to My YouTube Channel. Malls, Schools and similar locations have a higher expectation of a person's right to privacy and usually requires permission from an approved authority. In the case of a mall, management has concerns of store tenants and consumers to consider and protect.
In addition, unless we are taking videos in recognized "PUBLIC" locations and obtaining Release Forms from people that we video up close and interview, we may be taking a risk. Having the right to take a video does not necessarily give us the right to upload and share all videos. Even Mall Security Videos that are uploaded to YouTube for humorous content may result in legal problems for those that uploaded the video.
Just because we can get away with taking a video at any location, doesn't mean that we have the right to Upload and Post videos of "Restricted" sites and without required consent of individuals appearing in a video.
